Collect Memories - Barracud'Apps

Article 1 - Scope of Application

These Terms of Sale (hereinafter "ToS") govern the contractual relationship between:

The Service Provider:

  • Trade Name: Collect Memories (brand of Barracud'Apps)
  • Operator: Pierre LAMOTTE
  • Status: Self-employed primary activity (natural person)
  • Address: Rue de la Station 290, 5621 Morialmé, Belgium

And

The Client: Any natural or legal person ordering memory collection services offered by Collect Memories.

These ToS apply to all service orders placed on the website www.collect-memories.be or by any other means of communication.

Article 2 - Purpose and Description of Services

2.1 Main Service

Collect Memories offers a service for collecting, summarizing, and formatting the memories and life story of a person (hereinafter "the Interviewed Person"), comprising:

  1. Collection Phase:
    • Physical meetings at the home or location chosen by the Interviewed Person
    • Video and audio recordings of sessions
    • Note-taking by the field agent
    • Personality analysis
  2. Production Phase:
    • Transcription and summary of recordings
    • Writing of a personalized biographical book
    • Professional layout
    • Revisions with the Interviewed Person (2 rounds included)
  3. Delivery Phase:
    • Printing and delivery of a physical book (pocket format, soft cover)
    • Delivery of all digital files (videos, audios, notes, transcriptions)
    • Storage media (external hard drive)

2.2 Packages Offered

2.3 Additional Options

  • Ebook version
  • Video memory montage

Article 3 - Order Process

3.1 Initial Contact

The Client can make contact via:

  • Online form at www.collect-memories.be
  • Email: contact@collect-memories.be
  • VAT No.: BE0786897157

A free 45-minute qualification appointment is offered (video conference or phone).

3.2 Quote

Following the qualification appointment, the Service Provider prepares a personalized quote detailing:

  • The chosen package
  • Possible options
  • Total price including tax
  • Payment terms
  • Provisional schedule

The quote is valid for 30 days from its date of issue.

3.3 Order Acceptance

The order is considered firm and final after:

  1. Signature of the quote by the Client
  2. Signature of consent forms (see Article 4)
  3. Payment of the deposit (see Article 6)

Article 4 - Consents and Authorization

4.1 Consent of the Interviewed Person

Prior to any service, the Interviewed Person must sign a specific consent form authorizing:

  • Video and audio recording of their person and voice
  • Use of these recordings for book writing
  • Collection and processing of their personal data
  • Delivery of files to the Client

This consent is mandatory and may be withdrawn at any time (see Article 5).

4.2 Distinction Client / Interviewed Person

When the Client is different from the Interviewed Person (e.g., child ordering for their parent):

  • The Interviewed Person's consent remains mandatory
  • The Client signs a separate order form
  • In case of conflict, the will of the Interviewed Person prevails

4.3 Legal Capacity

The Client and the Interviewed Person must have legal capacity to contract. For persons under guardianship or curatorship, authorization from the legal representative is required.

Article 5 - Right of Withdrawal and Cancellation

5.1 Right of Withdrawal (Consumer Client)

In accordance with Belgian consumer protection legislation, consumer Clients have a period of 14 calendar days from the signing of the contract to withdraw, without justification or penalty.

Exception (service commenced): If the Client expressly requests commencement of the service before expiration of the withdrawal period, they waive their right of withdrawal for the portion of service already performed (Art. VI.53, 1° of the Belgian Code of Economic Law).

Exception (customised goods): Pursuant to Art. VI.53, 3° of the Belgian Code of Economic Law, the right of withdrawal does not apply to goods made to the Client's specifications or clearly personalised. As the memoir book is a bespoke work produced from the Client's own content, withdrawal cannot be exercised once personalised production has begun.

Where applicable, withdrawal is exercised by registered mail or email to contact@collect-memories.be, using the model withdrawal form below if desired.

Model withdrawal form (complete and return only if you wish to withdraw from the contract, where this right applies):

5.2 Cancellation by Client After Service Start

In case of cancellation after sessions have begun:

  • Sessions already completed: billed at 100%
  • Preparation time and travel: billed at 100%
  • Summary work already performed: billed at 100%
  • Deposit retained up to the amount of services performed

A detailed statement will be provided to the Client.

5.3 Withdrawal of Consent by the Interviewed Person

The Interviewed Person may withdraw their consent at any time, by simple written request (email or mail).

Consequences:

  • Immediate cessation of sessions
  • Destruction of all recordings and files within 30 days
  • No book will be produced or delivered
  • No refund to the Client (except commercial agreement)

The Client is informed of this right and accepts this risk by signing the quote.

5.4 Cancellation by the Service Provider

The Service Provider reserves the right to cancel an order in case of:

  • Force majeure
  • Inappropriate behavior by the Client or Interviewed Person
  • Manifest impossibility of performing the service
  • Non-payment

In case of cancellation by the Service Provider (not due to Client fault), full refund of amounts paid.

Article 6 - Price and Payment Terms

6.1 Price

Prices are indicated in euros, all taxes included, including Belgian VAT at the rate of 21%.

Prices include:

  • All travel within the covered geographic area (Belgium, Luxembourg, Northern France)
  • Recordings
  • Summary and writing work
  • Printing of one copy of the book
  • File storage media

Prices do not include additional options unless otherwise stated in the quote.

6.2 Price Revision

Catalog prices may be revised at any time. Applicable prices are those in effect on the date of quote signature.

6.3 Payment Terms - Individual Clients (B2C)

  • 30% deposit upon contract signature
  • 70% balance upon delivery of the printed book

Accepted payment methods: bank transfer, credit card (via secure platform).

6.4 Payment Terms - Professional Clients (B2B)

Payment by bank transfer:

  • 30% deposit upon order
  • Balance at 30 days end of month after delivery

6.5 Late Payment

Any late payment results in:

  • Suspension of service until regularization
  • Late payment interest at the Belgian legal rate
  • Flat fee of €40 (debt recovery)

Article 7 - Geographic Area

Home sessions are offered throughout Belgium.

Areas covered:

  • Belgium (all regions)
  • Luxembourg (Grand Duchy)
  • Northern France (Hauts-de-France region)

All travel costs are included in the package price for Belgium. For services in Luxembourg and Northern France, travel is also included at no extra charge.

Article 8 - Schedule and Calendar

8.1 Session Planning

The session calendar is established by mutual agreement between the Service Provider, the Client, and the Interviewed Person.

The Service Provider strives to respect date preferences, within the limits of availability.

8.2 Session Modification

Any request to modify a session date must be made at least 48 hours before the scheduled session.

In case of late cancellation or modification (less than 48 hours) without legitimate reason:

  • 1st occurrence: tolerance
  • 2nd occurrence: charge of €50
  • 3rd occurrence and following: charge of €100

8.3 Delivery Time

The book is delivered approximately 4 to 6 weeks after the last session, including the 2 revisions.

This time frame is indicative and may vary depending on project complexity and the Interviewed Person's responsiveness during revisions.

Article 9 - Revisions and Modifications

9.1 Included Revisions

Two (2) manuscript revisions are included in the price, to be performed by the Interviewed Person only.

These revisions cover:

  • Faithfulness of the narrative to the Person's words
  • Factual corrections
  • Wording adjustments

9.2 Additional Revisions

Beyond 2 revisions, any modification request will be charged €150 per additional revision.

9.3 Modifications Outside Revisions

Requests for substantial modifications (structure changes, complete chapter rewrites) not related to a Service Provider error may be subject to additional billing upon quote.

9.4 Final Validation

After the 2 revisions, the Interviewed Person signs an "Approval for printing." No modifications will be possible after this validation.

Article 10 - Intellectual Property

10.1 Ownership of Recordings and Narrative

The Interviewed Person retains ownership of their memories, words, and image/voice.

The book written by Collect Memories is a collaborative work:

  • The content (life narrative) belongs to the Interviewed Person
  • The form (writing, structure, layout) belongs to the Service Provider

10.2 Client Rights

The Client (if different from the Person) receives a private, non-commercial use license for the book and files.

10.3 Collect Memories Rights

Collect Memories retains the right to use anonymized excerpts or general statistics for communication purposes, unless expressly refused by the Client.

Any identifiable use (name, photo, recognizable excerpts) requires specific written authorization.

Article 11 - Confidentiality and Data Protection (GDPR)

11.1 Data Controller

The Service Provider is the controller of collected personal data.

11.2 Data Collected

Collected data includes:

  • Identity of Client and Interviewed Person
  • Contact details
  • Video and audio recordings
  • Life narrative (potentially sensitive data: health, opinions, etc.)

11.3 Purpose and Legal Basis

Data is collected for the execution of the service contract, based on:

  • Explicit consent of the Interviewed Person
  • Contract execution with the Client

11.4 Storage and Security

Collected files are stored on secure offline media (external hard drives).

No video or audio files are kept online or in the cloud.

Retention period by the Service Provider:

  • During service duration
  • Up to 30 days after file delivery to Client
  • Then complete destruction

11.5 Rights of Persons

In accordance with GDPR, the Interviewed Person and Client have the rights to:

  • Access data
  • Rectification
  • Erasure (right to be forgotten)
  • Restriction of processing
  • Objection
  • Portability

These rights are exercised by email to contact@collect-memories.be or postal mail.

Response time: 30 days maximum.

11.6 Complaint

In case of dispute, complaint possible with the Data Protection Authority (Belgium): https://www.autoriteprotectiondonnees.be

Article 12 - Liability and Warranties

12.1 Obligation of Means

The Service Provider undertakes to implement all necessary means to perform the service according to professional standards.

This is an obligation of means, not of result.

12.2 Limitation of Liability

The Service Provider cannot be held responsible for:

  • Inaccuracies, errors, or omissions in the narrative if they originate from the Interviewed Person's statements
  • Subjective literary quality of the book
  • Technical problems beyond their control (equipment failure despite backups, etc.)
  • Delays due to the Interviewed Person or Client

12.3 Material Warranty

The printed book and storage media are warranted against manufacturing defects.

In case of defect, free replacement within 30 days following delivery.

12.4 Insurance

The Service Provider is covered by Professional Liability Insurance.

Article 13 - Force Majeure

The Service Provider cannot be held responsible for non-performance of obligations in case of force majeure, including:

  • Natural disasters
  • Pandemic, epidemic
  • War, riots
  • General strikes
  • Widespread internet or electricity failure
  • Death or serious incapacity of the Interviewed Person or field agent

In case of prolonged force majeure (>3 months), the contract may be terminated without penalty, with refund pro rata for services not performed.

Article 14 - Contract Assignment

The Client cannot assign their rights and obligations without prior written agreement of the Service Provider.

Article 15 - Entirety and Modification of ToS

15.1 Entirety

These ToS, the signed quote, and consent forms constitute the entire agreement between the parties.

15.2 Modification

The Service Provider reserves the right to modify the ToS at any time.

Applicable ToS are those in effect on the date of quote signature.

Article 16 - Applicable Law and Jurisdiction

16.1 Applicable Law

These ToS are governed by Belgian law.

16.2 Language

In case of translation of the ToS, only the French version is authoritative.

16.3 Dispute Resolution

In case of dispute, the parties agree to seek an amicable solution.

Consumer Mediation (Consumer Clients):
In accordance with regulations, consumer Clients can use the free Consumer Mediation Service (SMC):

Competent Jurisdiction: Failing an amicable settlement, the courts of the district of Brussels have exclusive jurisdiction.

Article 17 - Miscellaneous Provisions

17.1 Partial Nullity

If a clause of these ToS is declared null or unenforceable, the other clauses remain in effect.

17.2 Tolerance

The fact that the Service Provider does not assert a Client's breach of any obligation under these ToS cannot be interpreted as a waiver to assert this breach subsequently.

17.3 Proof

The Service Provider's computerized records constitute proof of communications, orders, and payments between the parties.
